European Emergency passport /renew expired passport

Hi everybody!

Has someone experience with reaching out to a European consulate or embassy in the US for an emergency passport?
What documents did you need and how long did the emergency passport take?

I try to explain my situation in a nutshell.

I’m currently in the US. I realized recently that my child’s passport is expired.
I’m in an abusive situation marriage and wanted to go back to my family in Europe.
Problem is that my child’s passport has been expired for nearly a year.
The consulate explained that they need both parents and the child present for renewal. ( they don’t know my situation)

I was hoping the emergency passport might be another option.

Where are you?? This is a very good reason to carry a copy of your passport. If you have copy of your passport it is relatively easy to get a replace at an American consulate or embassy. They do it all the time. Just take whatever id you have an go. Probably take half day.

Years ago, landing in London, my passport didn’t have enough time left on it for me to make a connecting flight to Bulgaria, where excess expiration time was required. I needed a passport with a longer expiration date, and this was the Friday before an extended Memorial Day weekend closure, so it was kind-of an emergency. I made it to the US Embassy, and they sent me down the street to get new passport photos taken at a chemist (drug store). I came back with the photos and my current passport, and filled out some more paperwork. It took them the rest of the day, but I left right at closing time with a refreshed new passport. Procedures have probably changed in the last 15 years, though.

Are you at home, or a faraway location? Is your emergency that you don’t have a passport, and need one ASAP? Do you need to get somewhere, really soon? Do you need to get away from someplace, desperately? Is your current passport missing?

If the staff at the Consulate of your country don't know your situation I think it would be a good idea to tell them and see if they can use consular powers to protect and help you.

Don't know your country, don't know if that would help.

Most of EU countries making it very difficult even for their own citizens to travel. Do you know that if you get your child sorted you can still travel?

Does the airline or country require the permission of the father before you leave with the child, or even the US?

Legally I’m permitted to travel with my child. It’s only a problem if you are divorced or started divorce in the US.
I don’t know how consulates operate or who’s in charge in one country. I did once reach out and the person gave me actually wrong information.

We only have European passports.

I contacted a lawyer, trouble is in the US there is not much they can do about emotional abuse.

Thanks for the idea about another EU embassy, I need to look into that.

Seems the correct statement should be "We have passports issued by a European country" ( which you have not identified)

You need to contact the country that issued the passport. You have what appears to be a complex legal problem, involving your relationship with the child's father and what the requirements are for renewing it and being able to travel

You need to explain the situation and find out what it is they require for you to be able to renew the passport and return home

No one on this forum can give the needed legal advice, for your situation

How you got into the US with a passport that expired during your stay is an interesting, but unrelated issue.

First, you do not have an "EU" passport, you have a passport issued by a Country, that is part of the EU; What is that Country? That is the Consulate you would need to contact.

Even if the passport was not expired, leaving the Country with your child and not the knowledge of the other parent would not be allowed. The idea that you are able to leave now (Married), but not after you are divorced is incorrect. A Parent traveling alone with a child can be asked for proof of consent of the other parent under anti-trafficking laws.

If you are in danger or in an unlivable situation, address that first. Seek protection through local resources (Shelters, A Lawyer, Authorities, etc.), get safe, then worry about the next steps. Despite the situation, whatever it may be, both parents have legal rights that need to be resolved through the courts. Leaving the Country with the child seeks to circumvent that and can get you in more trouble.
