Glass Bottle Violations (Trastavere)

Hi, I recently visited Trastavere and observed at minimum hundreds if not thousands of people drinking in streets and public areas. I asked an English speaker in a shop if this was legal and he said yes and encouraged us it was fine. Well... come to find out it was actually illegal for him to even sell to us in the first place and I was instantly written a 280 euro fine for having a glass bottle.

I was told by some Italians I asked that I could just not pay it but that doesn't sound accurate to me. This feels like a sure fire way to end up with an arrest or 10x fine should I ever return. The link provided on the ticket for payment does not have any section to pay a violation whatsoever. Does anyone have any advice on how I can pay this ticket?

Well, to be clear, it is not illegal to him to sell you beer or wine, even in a glass bottles, it is not illegal for you to drink in the streets (no open container laws), what was a problem was the glass bottle. I had not heard of this, but probably a safety measure. In the popular areas of the Trastevere, litter is rampant, and broken glass common, so they must be trying to clamp down on it.

Hard to evaluate what happen. This is a typical first time poster coming here to complain about breaking the local laws. I am guessing they looked at his passport and took information from that document. Our normal advice is to figure out how to pay. Ignoring parking tickets has resulted in collection agencies coming after people a year or two after they returned to the US. Good luck.

The article posted by Threadwear states that "Anyone caught flouting the new regulation could face a fine of €150, while for business-owners selling alcohol after the time limit, that fine increases to €280." It doesn't sound like you were the business owner, so I wonder why they fined you €280 instead of 150.

If I were you, I would start by reaching out to the hotel where you stayed and ask them for advice.

Threadware is 100% right. Mpcronin92 as you pointed out, you were fined for having a glass bottle not for drinking alcohol in the streets. This is the real life and not an US movie where people can't drink outside because it's seen as immoral. They need a reason to temporarily ban normal things like drinking and imho Paul has already mentioned that reason: litter and broken glass.

A Mayor can enforce these bans only in a specific area of the city (Trastevere) for a limited period (summer months) and during a particular time slot (after 22). Where did you buy that bottle? In Trastevere? At what time? Before 22? Did you ask if drinking is illegal? Because drinking isn't illegal, strictly speaking the bartender was right. Did he hand you a plastic cup together with the bottle?

Nobody will arrest you for not paying a fine if you'll ever be back in Italy. This is not an Oliver Twist movie where those who don't pay a fine are imprisoned for debts. Nevertheless, the Italians who told you not to pay are young ignorant idiots that Live on the moon: if you don't pay the City will send a couple of registered letters to the address you gave the cops, then they will wait for 18 months for you to either pay or reply. Finally they will sell your debt to an international collection agency. Something the above mentioned Italian idiots have no idea about because Italian authorities can't sell Italian citizens' fines to private bodies.

Thanks for the responses, they are all helpful. They took down my driver's license info. They actually misspelled my middle name (which I don't think matters). They took down name address and DOB.

It is my understanding from later talking to a different officer who had a better understanding of English that the laws listed in the link above have since changed and apparently the shop (not bar) would not have been licensed to sell after 7PM this year due to more covid related restrictions. Apparently fines increased to 280 euro (400 euro if not paid within 5 days). Will check on the link

To the person saying I'm just complain please note the only question in my post was "Does anyone have any advice on how I can pay this ticket?" My intention was not to complain but to hopefully learn how to rectify it legally.

This is listed under a subsection for Città Metropolitana tickets though. My violation appears to be given by a different division which is "Roma Capitale".

The officer said I could only pay online but it seems like a potent lose lose situation for me to pay what seems like a different entity for a ticket and still not have the violation removed

Go to a police station?

More likely to find someone there more conversant in English than a random officer on the street.

I am not sure I have understood the above sentence, but keep things simple; if it's written you must pay on that site, just pay on that site.

It's the cop that fined you that matters, not the "division" where you assume you were. Can you see an 18 digits code beginning with 349 and called "Codice avviso / IUV"?

Only? "Online only" would be something never heard of, and some would say illegal given the 5 days limit to get the discount. Are you sure you were not given the paper slip to pay at the Post Office? This is what it looks like
