CBD Oil

I’m traveling from Philadelphia to Munich with a layover in Stockholm. My luggage will be carry on only. Can I take CBD oil with me (which will involve TSA and customs) or would it be better to buy it in Munich?

The CBD oil is legal even in states like North Carolina which doesn't have any legal medical or recreation marijuana. The CBD oil can be bought at Walmart or any drugstore here in NC. My only concern would be something that needs to go in the plastic bag taking up space. For that reason alone I would buy in Munich.

TSA won't care as long as what you have is in a 3 oz or smaller bottle in your liquids baggie. Customs might care in Germany when you arrive, but not sure as I don't know German law.

If you know you can find what you want in Munich, just buy it there and thereby eliminate and possibility of an issue.

From the TSA website:

...in the event a substance that appears to be marijuana or a cannabis infused product is observed during security screening, TSA will refer the matter to a law enforcement officer....

I don't know about the TSA website, but after passing the 2018 Farm Bill, CBD Products are no longer controlled substances or illegal in the US.

I think it best to leave the CBD at home for now.

As can be seen from the responses, there is much confusion about CBD due to the varying laws, and you will be trusting the judgement of either a TSA employee (make your own assessment of how well their training or competence is, I have met Great, Good, and Bad) or a Customs Official who does not speak your language.

CBD can be derived from either Hemp (Somewhat legal due to the recent Farm Bill but many questions on implementation) or Cannabis(Legal in some states, but illegal under federal law). The bottles do not always indicate which is the source so authorities sometimes go overboard.

So I say be safe and leave it at home unless you are interested in debating legalities with multiple authorities. Of course, you may slip through with no issues, x-ray won't detect it other than a liquid and rarely do you even see a euro zone Customs agent.

Since it is legal and available in Germany I would just wait until I got there to purchase it. No use stressing out and possibly getting it confiscated at the airport, or worse.

In my experience, it's best to make travel as easy as possible for ME when I am traveling.

I live in a state which only very recently OK'd the sale of CBD oil. Would I fly to another state with it? No. I wouldn't risk it. I definitely wouldn't risk it on an international flight.

It may be legal in my state. It may be legal in the state where I'm changing planes. Is it worth it to me to risk having a legal encounter when I'm traveling? No. In cases like that, TSA and law enforcement will have the first/last word and possibly cause you to miss your flight. Your decision may be different, of course. We all have different risk tolerances. I tend to default to what's the easiest thing for me.

Does nobody here know that there has always been controversy between States' Rights and Federal Jurisdiction as cannabis regulation changes? There is absolutely no assurance that a federal law enforcement officer will respond the same way as a state law enforcement officer in a state that permits some things that are still, today, illegal under federal law.

No one cares what Walmart or Walgreens is selling somewhere. Least of all law enforcement in other COUNTRIES that make their own laws. Are you kidding? Did you see any of the movies about Southeast Asian drug arrest stories? (I mean, like Midnight Express?) We're talking about the TSA, who are federal employees, and that's before you get to your destination.

Can't you live without an uproven, un-tested snake oil for a week or two?

That is a totally untrue and uncalled for comment. When you have pain that is relieved by a product it's quite possible that you could live without it, but your life might not be as comfortable and pain free without it. And there have been several studies that have shown the efficacy of CBD oil on some types of pain. It's not cheap and nobody uses it for nefarious purposes as it does not have the effects of THC.

Thank you to everyone who offered excellent advise about TSA rules, etc. and based upon such, I will not pack my oil. I must say though, this forum should be a place for travelers seeking answers and advise, NOT a place for criticism and judgment of others that you don’t know anything about. I am therefore turning off my notifications.

It's important that your oil does not cointain THC, (german law here). In U.S, THC is publicly accepted but in Europe it's different and especially in France where you product should not have been made using hemp flower. In general in Germany it's 0.2% of THC but i'm not sure if the custom are aware of this law (or have the tool to test the THC concentration ....)
